I was just told this by my bosses,No more smoking at or too and from work!
I'm a construction worker,we work with other companies on the same sites!This rule only applies to me!I'm the only smoker on my crew,at least the only one that will admit to it!We have a pipe smoker and several that chew,This they say is only in concern for my health! They provide no benefits,no insurance,it's no skin off their ass,but this still only applies to me!
One of the bosses admitted that it was to improve the companies image! Give me a break! take a look at any construction crew and what do you see? We aren't the suit and tie wearin' types! But these are my guidelines I'm to follow;
No smoking anywhere including in my own car!
No smoking on breaks or on lunch!
No smoking while wearing the company uniform
No smokes allowed on my person or in my car while at or traveling to and from work
Now this is a threat to my freedom of choice and my rights period! These are my thoughts on this,now tell me your opinion
What if this happened to you?
If your not a smoker how do you feel on this?
Would you, could you comply
Do you feel this would violate a persons rights?

There are no wrong answers here and I don't bite ,so give me your opinion!

They have a lot of nerve! How can they justify telling you what you can and can't do on your own time? Next thing, they'll be telling you when you can and can't go to the bathroom, what time you should go to bed, what you should be eating or something assinine like that.

They don't care about your health or else they would be giving you health insurance. I don't know what their problem is but they surely do have one (probably a bunch). Sounds like they need to kiss your ass and go to Hell! @!@

Sounds like they overstepped the mark.

Not only is it discrimination, but it also sounds like a term we have here in the UK, Constructive Dismissal. It's where a company tries to get you to leave the company because they have imposed certain rules on you that they know you will never adhere to.

Also, your time is your time unless you claim overtime.

I am a non smoker but they are really OTT on this one (on the other hand, it would be a damn sight better for your health !).

If the boss is not paying you, you're not wearing the company uniform and you're not driving a company car then they have no right to try and tell you what to do.

Well Spunky I agree with everyone else here. In Arkansas our illustrious governor recently pushed for and got the "Arkansas Clean Air Act" through. Now it is illegal to smoke in any restaurant or other business unless the business only allows customers 21 and older. You cannot smoke within 25 feet of the entrance of state buildings or city for that matter. No smoking in city or government owned vehicles (which includes police cars!) and so on and so on. The act even prohibits smoking in your own vehicle if you have a passenger under the age of 16. I happen to work in a city we have a smoking area around the side of the building. At least we can still smoke! I have always been courteous when smoking....asking if it would bother anyone else first, etc. But I'm so sick of hearing the negative things about smokers. Good luck sweetie! (By the way....we decided to prohibit ALL tobacco products at my place of the cars as well! If we can't smoke...they can't dip and spit!)

Hey Spunky, It seems everyone here has given you some great advice. At my job, we can't smoke within 25 feet of the entrances of any state building. This rule just started in the middle of July. But they did set up smoking areas for us. We also cannot smoke in state vehicles. I agree with everyone here. YOU NEED TO GET IT IN WRITING! I've heard of not being able to drink in work uniforms, but not smoking? That's ridulous. Talk to a lawyer!

What a crock of shit! They may have a right to stop you smoking at work, butno way can they interfere with your private life which includes your driving and your lunch time if you leave the job site. I think they have got to be on shaky ground here. Check it out with a lawyer.

We as smokers get descriminated against alot, talked down to and treated like shit sometimes. you just have to choose your battles.

No smoking at the job site is within their rights, but I DO NOT believe they can dictate what you do while traveling to and from work in your OWN car! As far as being in uniform goes....take the shirt off while traveling to and from work....I wish this "Non-Smoking" dictators would get off their high horses and back the fuck off us smokers. People that chew get to do so whenever they choose cause it is not within the sight of anyone. But, it is as hazardous and bad for your health as smoking is!!!!

I am a friend of countyheart and thought I would check out some of your post's and had to stop on this one but I see I am to late everyone has said it already. I am a somker and that is bull shit, I don't know what the hell they are thinking. It sound to me like they are trying to get you to quit, are these bull shit rule's for everyone or just you? I would ask why in my car and carry breath mint's and some kind of spray for your cloth's because I go without a smoke all day and I would be on a clock tower with a AK-47 aiming at my boss LOL.

I have to agree with everyone else on this one, Spunky, about the car thing. If your breaks and lunches are paid, then they can tell you to not smoke then also. But if it's unpaid and they don't want you smoking on the site, then you should be able to get in your car and leave to smoke. For any legal issues, you should be able to call any attorney in the yellow pages and ask them the legalities without a charge. Good luck in this and keep us posted,please.

I do not allow smoking on the premises nor while driving company vehicles. It you smoke, do so off the premises. It is the CEO's rule and it will stand. I have been challenged. As far as in your own vehicle, I don't understand that. I am a smoker and adhere to my own rule. It also applies to the spitters as well. Hope this helps spanky.

Your rules are not out of line and the fact that you as the CEO follow your rules is to be commended! I can understand the bans on tobacco(all forms) in the work enviorment today, and I an accept that!

Get them to give it to you in writing. Then take it to an attorney. Sure, they can restrict smoking while your on the job, but not in your own car. And since it only applies to you... "company image"... and not to the guys walking around spitting their wads and spit all over the place (no "company image" problem there? yeah right.) it sure looks like some form of discrimination... which is, I'm pretty sure, a violation of FEDERAL law.

Even though I am a non-smoker this has to be illegal. I think they can probably determine what happens on the job site and a code of conduct while in uniform however I can't believe they can force you to not have smokes in your car or prohibit you from smoking in your car away from the job site. You should come to Vegas lots of construction jobs and sadly smoking EVERYWHERE.

ok...they have no right and would be willing to bet that the human rights commission would take up your cause in a heartbeat and tell them the same (and they do it for FREE). As long as you aren't on the site itself smoking...they can't tell you what you can and can't do. No matter their intentions. It's called discrimination and it's illegal. They are overstepping their bounds and need to be brought back to reality on the issue.

I am a smoker and we are only allowed to smoke on the back patio at work.
When I was living with my mom ohh you would think my smoking was gonna kill her even when I smoked on the porch she had a cow.
But I have my own place now and smoke only in my dining room because that is where my computer is and the least likely place that the diva is most of the time.
But I would never work somewhere where I couldn't smoke.

I am a non smoker and this is the craziest shit I have ever heard of. Your right, construction workers aren't in suits, and when work is being done outside, what the hell is a cigarette going to hurt? They say it's for your health. What about people that leave work and go home and drink or eat too much? They can have health problems too! Nobody harps on drinking too much or over eating..( which by the way, you can draw a disability check by being obese, if you don't believe me, check into it, it's true)! What about that tobacco chewing...brown teeth, big lumps in jaw and possibly mouth cancer and they say a cigarette makes a bad image. Get real! And not in your own car are you allowed a cigarette. And who makes those car payments? And they don't offer any medical benefits...yet make these rules?
Hell yes this is a violation of a person's rights. Hell yes!

I smoke too. I would be furious if I was given these
so-called "rules" to follow. They can't tell you not to have cigarettes in your car. They can't tell you that you can't smoke on your lunch or on your breaks. They DO have the right to tell you that you can't smoke on a clients property. You can go across the street to get around that rule. What are they going to do? Search your vehicle? Pat you down for cigarettes? They aren't an illegal drug. They can't fire you for having nicotine in your system.

I'd tell them in a polite way that you feel the rules are unfair and if they pursue any punishment then you can file suit.
I would then make suggestions for much better ways to improve their "image".
1. Tell them that coffee shouldn't be allowed as it is a drug and can cause accidents on site if it is consumed too heavily.
2. Tell them that ALL workers must wear clothing that fits and does not reveal their ass crack when they bend over.
3. Tell them that no vehicle coming to or from the worksite should be allowed to have ANY bumper stickers, decals or logos. INCLUDING the Mexican flag.
4. Tell them that EVERY hardhat should be replaced at the companies expense every 3 to 4 months so that they always look new and shiny.
5. Tell them that there should be a rule against 1 guy doing all the work while 5 other guys stand around and watch.

Did they give these new rules in writing to you? Make them put it in writing before you say anything.

Grr... Want me to come there and kick someone's ass?
